  3. Failure to warn cases– Warning labels prove inadequate or misleading. For instance, a toy game might be safe for kids aged eight and up but be potentially dangerous to younger kids. If the manufacturer of the toy fails to include a age warning on the toy, and a three-year-old gets hold of a game piece and chokes on it, that child's parents can sue the game’s manufacturer for failure to warn.
