According to the law, there are three situations in which consumers may file a product liability claim.
- A product, component, or engineering design flaw caused injury or damages to property. Design issues can include everything from flawed engineering to poor packaging. If the manufacturer of the toy fails to include a age warning on the toy, and a three-year-old gets hold of a game piece and chokes on it, that child's parents can sue the game’s manufacturer for failure to warn.
